| Terms of Use
|
- You may not use the Cloak for any illegal purposes.
This includes but is not limited to the transmission or receipt
of illegal material.
- You may not use this service to contact or communicate with minors
in a manner prohibited by the law.
- You may not use the Cloak to violate copyrights
or to break other forms of intellectual property law.
- You may not use the Cloak to send spam
(unsolicited advertising, bulk email, mass news posts, or any other kind
of undesired large scale abuse of the net).
- You may not use the Cloak to harass
or annoy.
- If you have been blocked by the owner of a bulletin board or other
service that allows the posting of messages, you may not use this service
to bypass this blocking.
- Robots/web-crawlers and other non-human browsers may not use the Cloak.
The above is not a complete list; we reserve the right to
deny access for any reason.
In accordance with our abuse policy described below, we
reserve the right to turn over the IP addresses of people who
abuse our system either to the appropriate legal authorities, or to those
against whom abuse has been perpetrated. Use of this service
constitutes acceptance of the terms of our abuse policy.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
- This service is provided as-is, and the Cloak disclaims
all warrranties of any kind.
- The Cloak makes no warranty that this service will be timely
or uninterrupted.
- All material obtained through this service is done so through
your own discretion and at your own risk.
- YOU EXPRESSLY UNDERSTAND AND AGREE THAT the Cloak SHALL NOT BE LIABLE
FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR
EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS
OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES.
By using this service, you assert that you have read the disclaimer,
and that you agree to abide by the stated conditions for using this
service. You also understand that this service may not provide a 100%
guarantee of privacy and anonymity.

| Abuse Policy
|
- We have a strict anti-abuse policy. If it can be demonstrated to
what we consider a high degree of certainty that abuse has taken place,
we reserve the right to turn over any information we have on the abuser to the
complainant.
Here are some guidelines for what we consider to be abuse:
- The purpose of this service is to protect your privacy.
The purpose of this service is not to act as a
shield from behind which you can harrass and annoy others
with impunity. Improper behaviour by a small minority
of users causes us considerable inconvenience and
consumes significant amounts of our time. Such users should
not expect us to protect their anonymity.
- We consider abuse to be threatening, harassing, or otherwise
deliberately annoying behavior, or spam, or intellectual
property theft, or the planning or perpetration of illegal activity.
- If the behaviour (eg chatboard posts) is within the letter of
law, we do not consider abuse to have taken place until the
chatboard owner or webmaster has told the poster that
the poster's posts are not acceptable, and has asked the
poster to desist from making further posts. Such a warning
may consist of a post in the chatboard itself. Do not
use this service to post to chatboards where your presence
is not wanted!
- If an abusive poster has been warned, and persists to post to
the board against the owner's wishes, we reserve the right to
reveal the poster's IP address to the chatboard owner.
- If a chatboard owner is willing to tolerate posts that are
otherwise legal, we will not regard such posts as abuse:
the chatboard owner is the final arbiter of what he/she
will tolerate on his/her system.
- If a chatboard user feels that another user's otherwise legal
posts are abusive towards him/her, he/she should contact
the chatboard owner, and inform the owner of the terms above.
- The "one warning" policy above does not apply to
MLM, spam, or posting damaging or illegal content such
as viruses.
- If abuse is reported, but cannot be demonstrated, we will either
1) block the complainant's web site, so that no further abuse against
it can be perpetrated OR 2) we will block the suspected abuser's
IP address, if it can be determined.
- To report abuse, please do the following:
- Create a detailed report of what abuse took place. Save all
records - for example, harassing language on a bulletin board.
- Note the exact nature of the abuse, the web site at which
it occurred, and the exact time that it occurred.
Be sure to specify your timezone, preferably as an offset
from GMT.
The relevant server log lines are of great help.
- Report the abuse following the instruction on
our abuse pages.
Report the abuse immediately after
it takes place, so we can save the relevant logs.
- If we decide that abuse has been demonstrated to a high degree
of probability, we will turn over the abuser's IP address to you,
and you can pursue the matter further with the abuser's
service provider. Otherwise, we will institute blocking to
prevent further abuse.

| Privacy Policy
|
- We do not collect any personal or individually identifiable
information, or email addresses. The only information that we
have about our users is a record of their surfing through our
service, contained in our proxy logs. In these logs, users are
identifiable only by their IP number (network address). These
logs contain a record of web access made to and through our
service. These proxy logs are not revealed to anyone outside of
our organization, except such small portions that may be needed
to confirm abuse, and are deleted on a regular basis.
Our rules about revealing IPs are described in our
abuse policy above.
- We do not share the email address of people who contact us
with any third party.
- Our site uses login cookies to store temporary login information.
These cookies are not used for tracking users;
they are used only to keep a login session open. Once
a session is over, the login cookies are no longer used.
We use non-persistent cookies that automatically
expire and are deleted after you exit your browser. These
cookies are not correlated with individual user identities.
These cookies are technically necessary for using our service,
and cannot be disabled. You may also elect to store
your preferred settings in one or more persistent cookies.
- Our site may also set some cookies to control what advertisements
are shown. For example, we may use cookies to ensure that
we do not repeatedly show you pop-up advertisements. The
only information contained in these cookies is what time
a particular user saw a particular advertisement.
These cookies may persist for several days.
- Our site is secure to the best of our abilities.
We do our utmost to keep our site safe from
unauthorized access, and to minimize the number of
people who have access to sensitive information.
We cannot absolutely guarantee the security of our site,
and cannot be responsible for breaches of security.
- All use of our site is confidential. We only reveal
information if legally required to do so, or if
there is clear evidence of abuse our system,
as defined in our abuse policy (above) and
terms and conditions (above).
- You should assume that we will comply with
court orders or subpoenas demanding log files entries,
as we do not know our users and therefore
cannot mount a legal challenge.
- We keep records of accesses to our site for a short time
(several days). We may use these records to pursue
people who engage in an abuse of our services. Otherwise,
we do not share these records with any third party,
and we delete them after a short time (several days).
- We may run advertisements on our site. Our advertisers
have separate privacy policies. You are exposed to our advertisers at
the onset and termination of surfing using our service.
